Trade Licence – ट्रेड लाइसेंस – महत्व और इसकी आवश्यकता (व्यवसाय या व्यापार चलाने की आधिकारिक अनुमति)
किसी भी व्यापार या कारोबार को किसी निश्चित स्थान पर शुरू करने के लिए सबसे पहले
Trade Licence (TL) प्राप्त करने की प्रक्रिया से गुजरना पड़ता है। दुकान, व्यापारिक प्रतिष्ठान,
कंपनी आदि सभी को Trade Licence प्राप्त करना अनिवार्य होता है। जिस निश्चित स्थान का
चयन व्यापार करने के उद्देश्य से किया जाता है उसकी स्थानीय नगर निगम अधिकारी या
सरकारी प्रशासनिक अधिकारी से Trade Licence अनिवार्य रूप से प्राप्त करना पड़ता है।
Trade Licence एक सरकारी दस्तावेज होता है जिसके माध्यम से किसी निश्चित स्थान
पर व्यापार करने की अनुमति दी जाती हैं।
Trade Licence प्राप्त करने की क़ानूनी प्रक्रियां क्या हैं?
जिस निश्चित स्थान पर व्यापार के लिए Trade Licence प्राप्त करना होता है उसका जमीन
का दस्तावेज होना जरूरी है। अगर जमीन किराये पर लिया जा रहा हैं तो जमीनदार से
No Objection Certificate (NOC), Power of Attorney (POA) लेना अनिवार्य है।
इसके अलावा जमीन की Sketch Map, फोटो और व्यक्ति की KYC दस्तावेज
(आधार कार्ड, Pancard), आदि की भी जरुरत पडती है। सभी तरह के दस्तावेज
को पूरी तरह तैयार कर और TL के आवेदन का FORM भरकर नगर निगम या
प्रशासनिक कार्यालय में जमा करना पड़ता है। सभी औपचारिकताएं पूरी होने के
पश्चात, संबंधित अधिकारी द्वारा TL जारी कर दिया जाता हैं।
Trade Licence (TL) की जरुरत क्यों पडती है और इसका क्या महत्व है?
किसी भी वस्तु का उत्पादन के बाद और इस्तेमाल से पहले उसकी गुणवत्ता को परखा जाता है
ताकि जब यह बाजार या दुकान से घरों तक पहुचता है तो इसके इस्तेमाल से किसी पर कोई
बुरा प्रभाव न पड़े। सरकार की हमेशा से यह कोशिश रही है की व्यापार की माध्यम से जो भी
उत्पादन होता है और जिसका हम सभी इस्तेमाल करते है उससे हमारी सेहत दुरुस्त रहे और
कोई भी दुष्प्रभाव से बचे। ग्राहकों की हितों को ध्यान में रखते हुए तथा सचारू रूप से और
कानून के दायरें में रहकर व्यापार चलता रहें, इस मकसद से सरकार TL को जारी करता है।
किसी भी कंपनी या व्यापारिक प्रतिष्ठानों को सरकार की सभी मापदंडो को पूरा करना पड़ता है
और उसे पश्चात ही TL जारी किया जाता है। दुकान के नाम जारी किया गया TL जिसे
Shop Licence भी कहते है, उससे यह सुनिश्चित किया जाता है की सारे कारोबार क़ानून
के दायरे में रहकर हो रहा है।
Trade Licence से जुड़ी कुछ विशेष जानकारियां
Trade Licence को समय समय पर नवीकरण करना पड़ता है। दुकान के नाम या छोटे
व्यापारी वर्ग के नाम जारी TL को सालाना एक बार नवीकरण करना पड़ता है और कंपनी
या Farm के नाम पर जारी Trade Licence को कोई साल बाद नवीकरण करना पड़ता है।
यह एक क़ानूनी प्रक्रिया है इसीलिए नवीकरण को गंभीरता से लेना चाहिए। नवीकरण में
किसी भी तरह की लापरवाही या बगैर TL का कारोबार एक गंभीर क़ानूनी अपराध माना
जाता है जिससे दंड के रूप में जुर्माना या कारावास या दोनों का ही प्रावधान है।

Trade Licence – Importance and its necessity
(The Official Permission to run Business or Trade)
To start any trade or business in a certain place, one has to first go through
the process of obtaining Trade License (TL). Shops, business establishments,
companies, etc. are all required to obtain Trade License. TL has to be compulsorily
obtained from the Local Municipal Corporation or Government Administrative
Officer for the particular place chosen for the purpose of doing business.
A Trade License is a government document issued as a PERMIT through
which trade is allowed at a certain place.
What are the legal procedures for obtaining Trade License?
It is necessary to have a document of the land at the fixed place for which
the trade license is to be obtained. For the land taken on rent or lease,
it is mandatory to have a No Objection Certificate (NOC), Power of Attorney (POA)
from the landlord (actual owner of the land). Apart from this, a Sketch Map of the land,
Photos of the proposed site and KYC documents of the person (Aadhar card, Pancard),
etc. are also required. All types of documents have to be prepared completely and fill the
FORM of the TL application and submit it to the Office of the
Municipal Corporation or Administrative Officer. After completion of all formalities, TL is issued by the concerned officer.
Why is Trade License (TL) required and what is its importance?
The quality of any item after production and before use is examining so that when
it reaches the household members from the market or shop, its use does not affect
anyone. It has always been the endeavor of the government that whatever is produced
through trade and which we all use, our health should be kept well and avoid any side
effects. Keeping the interests of the customers in mind and considering the smooth
running of business according to Law, the government issues TL for this purpose.
Any company or business establishment has to meet all the criteria of the government
and only after that TL is issue. The TL issued in the name of the shop, also known as
Shop License, ensures that all business is being done within the purview of law.
Some special information related to Trade License
Trade license has to be renew from time to time. The TL issue in the name
of the shop or small traders has to be renew once a year and the Trade
License issue in the name of the company or farm has to be renew
after some year and in regular interval of time. This is a legal process
and that is why renewal of TL should be taken seriously. The business
without TL without its renewal is consider a serious legal offense.
Any violators dealt strictly with the provision of law as Penalty or
Imprisonment or both. So, it is always recommend to run
business through Trade License with regular RENEWAL.
